SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH STATES, PIZZA RANCH'S LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

8. Indemnification

Arbitration shall be conducted by a nationally recognized arbitration organization under its then-current rules for consumer disputes. The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding on both parties, subject to limited rights of appeal under the Federal Arbitration Act.

10.3 Class Action Waiver

YOU AND PIZZA RANCH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Unless both you and Pizza Ranch agree in writing, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

10.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies and remains in such court, provided the matter is brought and maintained as an individual (not class or representative) action. Either party may also seek emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
